The petitioner has been made accused in connection with Bermo P.S. Case No. 95 of 2024, corresponding to G.R. Case No.514 of 2024 for the offences registered under section 303(2) of the B.N.S, pending in the court of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.9513 of 2024 by order dated 19.11.2024. On 10.07.2024 motorcycle of the Informant parked outside Choubey Market was stolen away by unknown persons. During the course of investigation, stolen motorcycle was recovered from the possession of the petitioner. It appears that petitioner is an accused as many as 19 cases of similar nature. Learned counsel for the petitioner submitted that petitioner is in custody since 06.08.2024. The petitioner is habitual offender and is involved in organised crime of theft of motorcycle, considering the nature of allegation, I am not inclined to release the petitioner on bail.
