Neutral Citation No. - 2025:AHC:10526 Court No. - 5 Case :- WRIT - A No. - 717 of 2025 Petitioner :- Sirtaz Ali Respondent :- Power Corporation Through Managing Director Purvanchal Vidut Vitaran Nigam Ltd Varanasi And 2 Others Counsel for Petitioner :- Ramakant Tiwari Counsel for Respondent :- Adarsh Bhushan Hon'ble Ajay Bhanot,J. Heard Shri Ramakant Tiwari, learned counsel for the petitioner, Shri Adarsh Bhushan, learned counsel for the respondent no. 1 and Shri Devesh Vikram, learned counsel for the respondent nos. 2 and 3. The petitioner claims that he is entitled to arrears of salary for the period of suspension as well as the salary of the petitioner since June 2024. A representation in this regard has been made but to no avail. The only prayer made by learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Learned counsel for the respondents submit that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, learned counsels for the respondents fairly contend that the claim for arrears of salary is liable to be decided by the competent authority within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner regarding his claim for arrears of salary within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 22.1.2025 Vandit Digitally signed by :- VANDIT AGRAWAL High Court of Judicature at Allahabad
