This criminal miscellaneous petition has been filed by the petitioner under Section 528 of the B.N.S, 2023 with a prayer for modification of the order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 to the extent that in the address portion, the parentage of the petitioner be treated as “W/o Arun Vidyarthi” in place of “W/o Late Arun Vidyarthi.” It is submitted by the learned counsel for the petitioner that due to printing error in the petition of A.B.A. No.1534 of 2025, in the cause-title, the description of the petitioner has wrongly been mentioned as ‘Megha Kumari W/o Late Arun Vidyarthi’ though the husband of the petitioner namely Arun Vidyarthi is very much alive till now and because of the said erroneous description of the name of the husband of the petitioner in the cause-title, the same name is appearing in the order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 also. It is next submitted that unless the said modification is allowed, the petitioner will be highly prejudiced. Hence, it is submitted that the order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 be modified accordingly. Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for modification of the order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 is allowed. Accordingly, the order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 is modified to the extent that in the cause-title the words “W/o Late Arun Vidyarthi” be read as “W/o Arun Vidyarthi.” The order dated 06.03.2025 passed in A.B.A. No.1534 of 2025 is modified to the aforesaid extent only.
