CMP No.4892 of 2025 This application has been filed by Mr. Neel Kamal Sharma, Advocate, for withdrawing his power of attorney on the ground that appellant had engaged him as a counsel in this appeal, however, he has taken his case file/brief about 4-5 months ago. But, thereafter he has not turned up and, therefore, he is not in a position to represent and contest the matter on behalf of appellant. Taking into consideration the submissions made by learned counsel, his power of attorney filed on behalf of appellant is determined. Application is allowed and disposed of. FAO No.166 of 2014 There is no representation on behalf of appellant. Once appellant has filed the appeal, it is his duty to ensure his representation in the Court either in person or through counsel engaged by him In present case, appellant has engaged a counsel but later on he has withdrawn his case file from the counsel and did not turn up, which has caused filing of application by the counsel to determine his power of attorney. Power of attorney stands determined vide even dated order passed in CMP No.4892 of 2025. There is no representation on behalf of appellant, therefore, appeal is dismissed-in-default as well as for non-prosecution. Pending application(s), if any, shall also stand disposed of.
