The petitioner-Karan @ Ninja son of Sukha was arrested alongwith his co-accused. On the basis of the disclosure statement of the petitioner and co-accused/Karan son of Tarsem, the recovery of 06 motor cycles and 07 mobile phones has been shown to be effected but the same has been planted SUKHPREET KAUR 2025.09.13 23:47 I attest to the accuracy and integrity of this document chandigarh CRM-M-49974-2025 ::3:: upon them. Two co-accused of the petitioner, namely, Samarpreet Singh @ Sunny and Rohit @ Rohi have been granted the concession of bail by this Court vide orders dated 28.07.2025 and 11.08.2025 (Annexures P-4 and P-5 respectively). As the petitioner is in custody since 24.08.2024 but none of the 18 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail even though he is an accused in one other case. 4. The learned counsel for the State, on the other hand, contends that the nature of the allegations levelled against him do not entitle him to the concession as prayed for, moreso, when the recovery of stolen motor cycles and mobile phones has been effected on the basis of his disclosure statement as well as that of his co-accused. He, however, concedes that the petitioner is in custody since 24.08.2024 but none of the 18 prosecution witnesses has been examined so far and that two co-accused-Samarpeet Singh @ Sunny and Rohit @ Rohi have been granted the concession of bail. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 24.08.2024 but none of the 18 prosecution witnesses have been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. Two co-accused, namely, Samarpeet Singh @ Sunny and Rohit @ Rohi have been granted the concession of bail. In this situation, he can be granted the said concession as well. SUKHPREET KAUR 2025.09.13 23:47 I attest to the accuracy and integrity of this document chandigarh CRM-M-49974-2025 ::4:: 7. Thus, without commenting upon the merits of the case, the present petition is allowed and the petitioner, namely, Karan @ Ninja is ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned. 8.
