1. The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondent-Department to release the arrears of pension/pay, leave encashment occurred due to the implementation of the Punjab Sixth Pay Commission and further for issuance of directions to grant the gratuity to the petitioner under the payment of Gratuity Act, 1972 in view of the
judgment dated 17.02.2025 (Annexure P-6).

Learned counsel for the petitioners submits that for claiming the aforesaid relief, the petitioners have submitted a legal notice dated 12.05.2025 (Annexure P-8) and at this stage, the petitioners would be satisfied, if the said legal notice is decided by passing a speaking order in a time bound manner.

Learned State counsel, appearing on advanced notice, submits that he has no objection in case a direction is issued to respondent No.2 for time- bound consideration and decision of the legal notice of the petitioners by passing a speaking order. Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.2 is directed to consider the legal notice dated 12.05.2025 (Annexure P-8) of the petitioner in terms of CWP No.14765 of 2025 titled as ‘Ramesh Kumar and others Vs. State of Punjab and others’ (Annexure P-9) and CWP No.20257 of 2024 titled as ‘Balwant Singh and others Vs. State of Punjab and others’ (Annexure P-10) and pass a speaking
order, after affording them an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondent No.2.

Disposed of, accordingly.
