JUSTICE AHANTHEM BIMOL SINGH 09.05.2025 [1] Heard Mr. N. Jotendro, learned senior counsel assisted by Md. Abdul Baqee Khan, learned counsel appearing for the petitioners and Mrs. L. Monomala, learned GA appearing for the respondents. In view of the limited prayer made on behalf of the petitioners and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the admission stage. [2] It has been submitted by Mr. N. Jotendro, learned senior counsel appearing for the petitioners that for redressing the grievances raised in the present writ petition, all the petitioners have submitted separate representations are all dated 13.01.2025 (enclosed herewith as Annexure-A/15 (Colly series)) to the Commissioner (Family Welfare), Government of Manipur and that KABORA MBAM SAPANA CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2025.05.09 15:40:18 +05'30' Page 2 the said representations are still pending for consideration and disposal. The learned senior counsel further submitted that the petitioners will be satisfied for the time being if the writ petition is disposed of by directing the Commissioner (Family Welfare), Government of Manipur to consider the aforesaid representations submitted by the petitioners on its own merit and strictly in terms of applicable law and to dispose of the same by issuing a speaking order within a stipulated period. [3] Mrs. L. Monomala, learned GA appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioners is confined to the consideration and disposal of the representations submitted by them she has no objection in disposing of the present writ petition as prayed for by the learned senior counsel appearing for the petitioners. However, it has been submitted by the learned GA that an observation be made that while passing this order, this Court has not touch upon the merit of the present writ petition. [4] Considering the submission advanced by the learned counsel appearing for the parties and on perusal of the record, this Court is of the considered view that interests of justice will be served by disposing of the present writ petition with the following directions:- Page 3 (1) The Commissioner (Family Welfare), Government of Manipur is hereby directed to consider the representations submitted separately by all the present petitioners all dated 13.01.2025 on its own merit and strictly in terms of applicable law and to dispose of the same by issuing a speaking order. (2) The whole process should be completed within a period of 3 months from the date of receipt of a certified copy of this order. (3) It is made clear that this Court did not consider or touch upon the merit of the present writ petition at the time of passing this order.
