The present criminal appeal has been filed against the judgement and order dated 19.3.2008 passed by Additional District and Sessions Judge, Court No. 8, Gorakhpur in Sessions Trial No. 410 of 2005 (arises out of Case Crime No. 504 of 2005) (State vs. Raghvendra and others), under Sections 302, 201 IPC Police Station Belipar, District Gorakhpur whereby convicting the appellant under Section 302 IPC for life imprisonment along with fine of Rs. 3000/- and under Section 201 IPC for imprisonment of two years along with fine of Rs. 500/- and in default of payment of fine one year further imprisonment. 2. As per office report dated 07.5.2025 based on the report of Chief Judicial Magistrate, Mau dated 06.01.2025, sole appellant Raghvendra Rai died on 26.11.2018. Alongwith the said report statement of Dhirendra Rai, real brother of the sole appellant as well death certificate of the appellant Raghvendra Rai issued by Muktidhan Seva, Sansthan, Gauri Shankar Ghat, Dohri Ghat, Mau has also been annexed. 3.
