ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagar'lk Suraksha Sanhita, 2023, is filed on behalf of the petitioner to grant anticipatory bail in connection with Crime No.17/2025 of Prohibition & Excise Station, Hindupur. 2) A case has been registered againstthe petitioner and others for the offences punishable u/Sec.7-B read with 8-B & 8-C of the A.P.Prohibition Act. 3) Case of the prosecution in brief is that on 07.01.2025 as per the orders of the Director of Enforcement Proh & Excise, Vijayawada, vide C.No.DOE/2025/B2, dated 07.01.2025, police conducted raids in several places. Accordingly, they raided the scene of offence at Rachupalli Cross and Konduru Cross to Balampalli bus road of Chalivendula Village, Hindupur, where they found 48 Tropicana VSOP Brandy pet bottles of spurious liquor in a polythene bag in possession of A1. Police seized the contraband and registered the F.I.R. and arrested A1. 4) Heard. Perused the record. t>i- I-z¢ 'l+.,--- ---,'
2 5) Learned counseF'for the petI'tlOner submI-tS that a false case is foisted agalnst the petitioner hereI-n and the petitI'Oner is no way connected to the alleged crI-me. Further, the learned counsel for the petl-tioner subm,Its that the petitioner neI'ther involved l'n the alleged crime nor was present at the scene of offence. 6) on the other hand, learned AssI-Slant Public prosecutor opposed \ grant of anticipatory ba" on the ground that investigatI-On js pending 7) A perusal of the materl-a' on record shows that the petl'tIOner was not apprehended at the scene of offence. Nothlng has been seized from the possession of the petI|tI'Oner herein. ln the facts and circumstances of the case, this court is I-nclined to consider the prayer of petl'tioner for grant of antjcI'PatOry bat-I, however, on certain condl-I,Ions. 8) AccordI-ngly, I.n the event of arrest of petjtI-Oner with regard to thIS crime, he sha" be released on ba" on h,-s executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) wl'th two suretI-eS each for the 'I'ke sum to the satisfaction of the arresting police officials and also on condI|tiOn that the petitioner sha" make himself avallable for lnVestI'gatI'On as and when required and that he sha" not cause any threat, I'nducement or promise to the prosecution witnesses. iii= iiiE
Petitioner shall appear before the station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p,m,, till filing of the charge-sheet.
