1. This is an ofÏce reference.
2. This Court, vide order dated 13.03.2024, passed in MCRC No. 1658 of 2024, while rejecting the bail to the applicants, namely, Thansingh Kurre and Deepak Kumar Jangade, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 impediment.
3. Earlier on one occasion also this Court had granted extension of time for compliance of the order dated 13.03.2024.
4. The learned Special Judge (NDPS Act), Raigarh (C.G) vide his request letter dated 28.01.2025 has requested for grant of some more time for concluding the trial.
5. It transpires from perusal of the PUD that in this case, a total of 09 prosecution witnesses have been examined and two prosecution witnesses are yet to be examined. The case was previously under the jurisdiction of the First Additional Sessions Judge for hearing cases related to the NDPS Act. However, due to the vacant in that Court, the concerned Court has been granted jurisdiction to hear NDPS cases as per the order of the Honourable High Court (Order No. 400/Checker/III-6- 1/(Part-III) N.D.P.S. Bilaspur dated 08.01.2025). Therefore, it is not possible to conclude the trial within the specified time, therefore, he prays for grant of further more time for concluding the trial.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
