HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3238/2025 Mahendra Kumar S/o Shri Ramcharan, Aged About 30 Years, R/o Ukroond, Police Station Mandawar, District Dausa (Rajasthan) (At Present Accused Petitioner Confined In Central Jail Mandawar (Dausa) District Dausa Rajasthan) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ram Ratan Gurjar For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 11/03/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 41/2025 registered at Police Station Mandawar, Dausa District Dausa for the offence(s) under Sections 115(2), 126(2), 307, 119(1) and 324(4) of BNS.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that complainant Akshay Raj has entered into compromise with the present petitioner and executed an affidavit, which is placed on record as Annexure-3, the same has also been referred in the impugned order. The injuries sustained to injured Saroj was found to be simple blunt in nature. It is also contended that petitioner never demanded any money for liquor from the complainant and FIR itself is delayed by 13 days. The accused petitioner is in custody since 18.02.2025 and the investigation against the
(2 of 2) [CRLMB-3238/2025] present petitioner has already been concluded and further trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application and submitted the factual report. Same is taken on record. Heard and perused the material available on record. The injury sustained to injured Saroj is found to be simple blunt in nature and apart from one injury there is no injury at the body part of injured. FIR itself is delayed by 13 days and the accused-petitioner and complainant Akshay Raj have entered into compromise and the same is placed on record as Annexure-3 with the bail application. It is not desirable to express anything on the merits of the case, considering the fact that petitioner and complainant have arrived at compromise and petitioner is in custody since long and the trial of the case will take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mahendra Kumar S/o Shri Ramcharan, in connection with FIR No. 41/2025 registered at Police Station Mandawar, Dausa District Dausa shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
