HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 11523 of 2025 Court No. - 9 HON'BLE MANISH KUMAR NIGAM, J. 1. Heard learned counsel for the parties and perused the record. 2. This petition has been filed challenging the order passed by the District Judge dismissing the appeal for want of jurisdiction as the value of civil appeal is stated to be Rs.70,00,000/-. 3. Contention of learned counsel for the petitioner is that the petitioner has only paid court fees on 1/5 of the valuation of the suit therefore, the appeal will lie before District Judge. 4. Contention of learned counsel for the petitioner is wholly misconceived and it is the valuation of the suit and the appeal which decide the forum as to whether the appeal will lie to the High Court or to the District Court. 5. No illegality has been committed by the court below in rejecting the appeal. 6. Consequently, the writ petition is dismissed. September 23, 2025 S.
