HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 21205 of 2025 Court No. - 42 HON'BLE J.J. MUNIR, J.
HON'BLE PRAMOD KUMAR SRIVASTAVA, J. This writ petition has been filed seeking to quash the first information report dated 11.06.2025 giving rise to Case Crime No. 137 of 2025 under Sections 191(2), 126(2), 109, 308(2), 61(2), 352, 351(3) B.N.S., P.S. Dehli Gate, District Aligarh. A perusal of the impugned FIR shows that though it is a case of no injury, but there are serious allegations of an attempted murder, where assault is alleged using sharp edged weapons, as also the petitioner opening fire on the informant. Learned Counsel for the petitioners argued that the parties have compromised the matter, and, therefore, the FIR ought be quashed. If there indeed has been a crime of this kind, this Court should not be a party to the parties' comprising the heinous offence, which is otherwise, not compoundable. In certain cases, indeed non-compoundable offences too can be compromised, but not in the background of the present matter, and that too, at an incipient stage of investigation. Mr. Dipak Mishra, learned Additional Government Advocate, on instruction received, points out that petitioner no. 1 has a criminal history of seven cases, including the present one. The first petitioner's criminal history is detailed below:
(2) मु0अ0सं0-617/2019, अ०धारा-323, 354, 452, 506 भ०द०स०, थाना-देहलीगेट, िजला-अलीगढ़़़ Versus Counsel for Petitioner(s) : Ajay Kumar Shukla, Pawan Kumar Gupta Counsel for Respondent(s) : G.A. Sunil And 4 Others .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s)
Apart from that Mr. Mishra Points out that there is a CCTV footage of the incident also. This is a matter, where the State would primarily be the prosecutor and would have the first interest in pursuing the prosecution against an offender of this kind, if the allegations be proved. In this jurisdiction of ours, it is not our province to find out if the allegations are true or untrue.
In the totality of the circumstances, we do not find it to be a fit case to interfere with the impugned FIR under Article 226 of the Constitution. This petition is dismissed summarily. Let this order be communicated to the Senior Superintendent of Police, Aligarh through the learned Chief Judicial Magistrate, Aligarh by the Registrar (Compliance) by Monday.
