The instant public interest litigation has been filed for the following reliefs: "issue a writ, order or direction in the nature of mandamus commanding the respondent to take the appropriate action against the private respondent nos.5 & 6 who are alleged to have encroachment upon land in the Gaon Sabha i.e. (Mukhya Marg) Arazi No.1646 Rakba 0.0190 Hectare, situated in Village- Baraini Pargana Kasiwar, Tahsil- Sadar, District- Mirzapur (Annexure No.1 to this writ petition)." 2. Mr. Anjani Kumar Chaurasia, learned Additional Chief Standing Counsel for the State placed the instruction dated 8.10.2025 sent by Tahsildar, Sadar, Mirzapur before this Court, which is taken on record. 3. Learned Additional Chief Standing Counsel for the State-respondent on the basis of instruction dated 8.10.2025 submitted that the proceeding under Section 67 of U.P. Revenue Code, 2006 has already been registered against the persons who have been found in possession over the plot in question. He further submitted that the next date fixed in the proceeding is 18.10.2025. The particular of the case registered under section 67 of U.P. Revenue Code, 2006 is as under : "Case No.20304 of 2024, Computerized Case No.T202516530120304." 4. In view of the fact that proceeding under Section 67 of U.P. Revenue Code, 2006 has already been registered in respect to the plot no.1646, no further cause of action survives in the matter.
