HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 32950 of 2025 Court No. - 6 HON'BLE PRAKASH PADIA, J. 1. The petitioner is an elected Pradhan of Gram Panchayat Garhi Balan, Vikas Khand Hathras, District Hathras against him a criminal case being Case Crime No.186 of 2018 under Sections 147, 148, 302/149, 307/149, 504 & 506 I.P.C was registered. In the aforesaid case, Sessions Trial No.348 of 2018 (State of U.P. Vs. Rajan Singh and others) was started and the petitioner has been convicted for life imprisonment by the Trial Court vide judgement and order dated 18.06.2024. Against the aforesaid judgement, the petitioner preferred Criminal Appeal No.6248 of 2024 before this Court and in the aforesaid case, the petitioner has enlarged on bail by this Court by order dated 24.02.2025. 2. It is argued by learned counsel for the petitioner that after the conviction of the petitioner in the aforesaid Sessions Trial, the respondent No.2/District Magistrate, Hathras ceased the power of the Petitioner as Pradhan and handed over the charge of the Pradhan to one Nagendra Kumar and directed him to perform the duties of Pradhan vide order dated 25.09.2025. It is argued that after getting the bail from this Court in the aforesaid Criminal Appeal, the petitioner submitted an application before the respondent No.2 on 06.06.2025 to permit the petitioner to work on the post of Pradhan. It is argued that considerable time has alredy been lapsed but till date no decision has been taken in the matter. 3. On the other hand, it is argued by learned Standing Counsel that the respondent No.2 will take a decision in the matter expeditiously. 6. Heard learned counsel for the parties and perused the record. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/District Magistrate, Hathras to take a decision in the matter strictly in accordance with law expeditiously and preferably within a period of of four weeks from the date of production of certified copy of this order unless there is no legal impediment. 8. In case, decision has already been taken in the matter, the same be communicated by the respondent No.2 to the petitioner forthwith.
