The petitioner is working with the NCC. He is posted at Pithoragarh. By the impugned transfer order dated 10.06.2025, the petitioner has been transferred to Roorkee, District Haridwar. It is impugned. Learned counsel for the petitioner submits that the petitioner has wrongly been transferred; the petitioner has given a representation on 14.07.2025, which is Annexure No.5 to the writ petition, but it has yet not been decided. The Court wanted to know from learned counsel for the petitioner as to why the writ petition should be entertained for challenging the transfer order after two months. Learned counsel for the petitioner submits that there is inter-departmental procedure to make representation. The petitioner also did make representation, but it has yet not been decided, whereas the co- workers’ representation has been decided, there, the transfer orders have been modified; thereafter, the second representation dated 14.07.2025 has been submitted by the petitioner. He submits that the respondents may be directed to decide the representation dated 14.07.2025, which is Annexure No.5 to the writ petition, within a stipulated time, by a reasoned and speaking order. Learned counsel for the respondent nos. 2 and 3 submits that the petitioner has been working for about 19 years in remote areas. Therefore, he has been transferred, and the transfer order is validly passed; the representation that has been given by the petitioner dated 14.07.2025, which is Annexure No.5 to the writ petition, will be decided within a week. The Court takes on record the statement given by learned counsel for the respondent nos. 2 and 3. The writ petition is disposed of with the direction to the respondents to decide the representation of the petitioner dated 14.07.2025, which is Annexure No.5 to the writ petition, within a week from today, with a reasoned and speaking order.
