With consent of the learned counsels on either side, the writ petition is taken up for final disposal. 2. This Writ Petition has been filed to direct the respondents herein to disburse the salary/subsistence allowance for the suspension period from 31.07.2020 to 30.07.2021 and consequently, direct the third respondent to disburse the regular salary from 17.03.2023 onwards, together with applicable arrears and benefits and pass orders. 3. The case of the petitioner is that the disciplinary proceedings were initiated against the petitioner by the third respondent, thereby he was placed under suspension and thereafter, he was dismissed from service, against which, the petitioner preferred an appeal before the second respondent. The 2/5 https://www.mhc.tn.gov.in/judis second respondent modified the dismissal order and directed that the period from 31.07.2020 to 30.07.2021 shall be treated as “suspension period” and the remaining period as “leave without pay”. Thereafter, the respondents failed to disburse the salary allowances for the above said suspension period and regular salary from 17.03.2023 onwards. Challenging the same, this petition has been filed for the aforesaid relief. 4. When the case came up for hearing, the learned Additional Government Pleader for the respondents would submit that the petitioner has given a representation seeking for time-scale pay. The Commissioner, in his proceedings, Moo.Mu.No.6434/2022/T4 dated 04.11.2022, had modified the benefits from time-scale pay to consolidated pay and the amounts are being paid as per the order of the Commissioner from 17.03.2023 regularly to the petitioner's bank account.
