No. 758 of 2025 PRAYER This Writ petition has been filed under Article 226 of the Constitution of India to issue a writof mandamus directing the respondents 1 and 2 to provide adequate police protection for ingress and egress of vehicles and people in and out of factory premises, ensure no workers assemble illegally from 500 meters from petitioner factory premises viz, No.B-2, Sipcot Industrial Complex Kudikadu - Cuddalore and indulge in any violent activities, carrying out any protests demonstrations, meetings and disrupting its manufacturing activities in any manner, in pursuant to the complaint dated 29/08/2025. WP Crl. No. 758 of 2025 Complex, Kudikadu, Cuddalore pursuant to the complaint of the petitioner dated 29.08.2025. 2. It is the contention of the learned counsel for the petitioner that third respondent Union claiming to represent the workmen submitted a Charter of Demands, which is the subject matter of Conciliation in Na.Ka.No.343 of 2025, while conciliation is pending, the Union resorted to an illegal strike on demands unconnected to the petitioner's establishment and has further threatened direct action, including strikes, demonstration and obstruction of ingress and egress of men and materials. He added that despite the repeated representations, the respondent police have not taken any action to prevent the same. Hence the petition.
3.The learned Government Advocate (Crl.Side) undertakes to provide necessary police protection to the petitioner company for ingress and egress of vehicles and people from in and out of the factory premises and further prevent trespassing workmen by ensuring no striking workers assemble illegally and other activities are not affected in the premises. 3/5 https://www.mhc.tn.gov.in/judis
WP Crl. No. 758 of 2025 4.In such view of the matter, it is the duty of the police to provide necessary protection and prevent any unlawful activities by the agitated employees in the premises. If the workmen wanted to show their protest in a democratic way, they can do such protest out of the radius of 500 meters from the premises after obtaining necessary permission from the concerned jurisdictional police. 5.Subject to the above observation, this Writ Petition stands disposed of.
