ORDER 28-03-2025 Heard Mr. N. J. Dutta, learned counsel for the petitioner and Mr. M. P. Goswami, learned Additional Public Prosecutor, Assam. 2. The petitioner, namely, Ariful Islam, son of Jalal Uddin, resident of Village-Bakhuamari, P.O.-Kayakuchi, Police Station-Barpeta, District-Barpeta, Assam, presently residing at
Page No.# 2/3 Aziznagar, Fakiruddin Ali Ahmed Path, Panjabari, Police Station-Dispur, has filed this application under Section 483 BNSS, 2023 on 24.03.2025 seeking bail in Dispur Police Station Case No. 33/2025 registered under Sections 303(2)/318(2) BNS, 2023, corresponding to G.R. No.261/2025, in which he was shown arrested on 29.01.2025 and is in custody since then. 3. Petitioner’s earlier Bail Appln. No. 436/2025 in said Dispur P.S. Case No. 33/2025 was rejected by this Court vide order dated 18.03.2025. 4. After being shown as arrested on 29.01.2025, the petitioner was produced before the Court of learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati on 29.01.2025 in said Dispur P.S. Case No. 33/2025 and he is custody for about 59 days till date in said Dispur P.S. Case. 5. On being enquired, M. P. Goswami, learned Addl. PP, Assam submitted that charge sheet in said Dispur P.S. Case No. 33/2025 has not been filed till date. 6. Since 29.01.2025, the petitioner has been in custody till date for about 59 days. In view of the above, the petitioner is entitled for his bail in said Dispur P.S. Case No. 33/2025. 7. Accordingly, the petitioner, namely, Ariful Islam, son of Jalal Uddin, if not wanted in any other criminal/police station cases, is granted bail in said Dispur P.S. Case No. 33/2025 registered under Sections 303(2)/318(2) of BNS, 2023 corresponding to G.R. No. 261/2025, on furnishing a bail bond of Rs.
75,000/- with two local sureties each of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati on condition that the petitioner – (i) shall appear before the Investigating Officer of said Dispur P.S. Case No. 33/2025 as and when he is required in the said Dispur P.S. case; (ii) shall not leave the territorial jurisdiction of Dispur Police Station, without obtaining prior written permission from the concerned Investigating Officer of the case; (iii) shall not hamper with the investigation, or tamper with the evidence of the case;
Page No.# 3/3 (iv) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer and (v) shall not involve himself in any criminal activities in future. 8. Violation of any of the aforesaid terms and conditions by the petitioner, namely, Ariful Islam, son of Jalal Uddin, then the bail granted to him in the aforementioned Dispur P.S. Case No. 33/2025 shall stand automatically vacated. 9. Accordingly, this bail application stands disposed of to the extent above. JUDGE
