JUSTICE RAJESH KUMAR VERMA ORAL ORDER 2 18-11-2025 Heard Mr. Baidyanath Prasad, learned counsel for the petitioner and Mr. Mohammad Sufyan, learned APP for the State. 2. The petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 38 of 2025, F.I.R. dated 15.02.2025 for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 3(5) of the Bharatiya Nyay Sanhita, 2023 and under Section 27 of Arms Act. 3. According to prosecution case, the informant alleged that when he was going to village Baisaila to meet his relatives and reached near khatway tola at village kakarghat then the petitioner along with other accused persons arrived and began snatching key of his motorcycle and mobile phone. On Patna High Court CR. MISC. No.76454 of 2025(2) dt.18-11-2025 2/2 protest, the accused persons assaulted him and one of the accused fired on the leg of the informant due to which he fell down. 4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case due to some previous dispute. 5. The learned Additional Public Prosecutor on the basis of materials available on record has vehemently opposed the prayer for bail of the petitioner and submits that from bare perusal of the FIR it transpires that there is direct and specific allegation against the petitioner that he has fired upon the victim and he has received bullet injury. 6. Considering the aforesaid facts and circumstances and the fact that there is direct and specific allegation of firing upon the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Sadar P.S. Case No. 38 of 2025 pending in the court of C.J.M., Darbhanga. 7. Prayer is refused. Suruchi/- (Rajesh Kumar Verma, J) U T
