Uddin, learned counsel for the applicant and Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam. Also heard Mr. D. Kalita, learned counsel for the respondent no. 2. This is an application filed under Section 389 of the CrPC praying for suspension of sentence and for allowing the applicant Sahidul Islam @ Jakir to go on bail, who has been convicted pursuant to the Judgment and Orders dated 10.01.2023 and 11.01.2023, passed by the learned Special Judge (POCSO), Nalbari in Spl. (P) Case No. 27/2021. The applicant has been sentenced rigorous imprisonment for 10 (ten) years. According to Mr. Kalita, the learned counsel for the respondent no. 2 submits that he has no objection if the prayer for bail of the applicant is allowed. Mr. Goswami has submitted on the basis of the objection. I have considered the submissions made by the learned counsel for both the sides. I have also gone through the Judgment and Order aforesaid. Considering entire aspect of the matter, the applicant Sahidul Islam @ Jakir, who has been convicted pursuant to teh Judgment and Orders dated 10.01.2023 and 11.01.2023, passed by the learned Special Judge (POCSO), Nalbari in Spl. (P) Case No. 27/2021 is allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Special Judge (POCSO), Nalbari. The IA(Crl) is disposed of.
