JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 25-11-2025 Heard learned counsel for the petitioners as well as the learned APP for the State. 2. The petitioners apprehend their arrest in connection with Main P.S. Case No. 70 of 2023, registered for the offences punishable under Sections 302, 201, 304(B), 34 of the Indian Penal Code. Patna High Court CR. MISC. No.36907 of 2025(3) dt.25-11-2025 2/3 3. As per the written report of informant, his daughter Mamta Kumari was married to Sonu Das (petitioner) on 14.05.2021. Soon after marriage, the accused persons subjected her to physical and mental torture for demand of dowry. On 27.05.2023, the deceased informed the informant’s daughter-in- law on telephone that she was being pressured to bring money and ornaments, otherwise, the accused persons would kill her. It is alleged that on 03.06.2023, due to non-fulfillment of the dowry demand, the petitioner along with other accused persons killed Mamta Kumari and cremated her dead body. 4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The allegation is general and omnibus. The deceased died due to snake bite and both the parties have compromised the case. Petitioner Chunnu Das @ Rakesh Kumar, who is devar of the deceased, has no concern with day- to-day affairs of the couple. 5. Considering the above-mentioned facts and circumstances, let the petitioner Chunnu Das @ Rakesh Kumar (Cr. Misc. No. 43173 of 2025), in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. Patna High Court CR. MISC. No.36907 of 2025(3) dt.25-11-2025 3/3 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Gaya in connection with Main P.S. Case No. 70 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. 6. The deceased died within two years of her marriage in her matrimonial house in suspicious circumstances and her dead body was cremated stealthily. The petitioner Sonu Das (Cr. Misc. No. 36907 of 2025) is the husband and the onus goes upon him to explain the cause of death of the deceased. The allegation against him is serious and grave in nature. 7. Considering the above-mentioned facts and circumstances, in my view, the petitioner Sonu Das (Cr. Misc. No. 36907 of 2025) doesn’t deserve the privileges for anticipatory bail and the same is rejected. kundan/- (Nawneet Kumar Pandey, J) U T
