There is a factual deficit in the writ petition, in presence of which this Court cannot entertain the present writ petition at the instance of the petitioners to prima-facie hold that the petitioners are being subjected to any harassment by the local police station, be it Police Station Bishnah or Police Station Miran Sahib. 02. This Court, being a Constitutional Court, is meant to protect the life and property of a citizen as a fundamental right in terms of Article 21 of the Constitution of India, but for that the facts are to be reported by an aggrieved person and not fancy or fiction. 03. The learned counsel for the petitioners seeks to withdraw the petition with liberty to file, on the basis of which it is to be pleaded by the petitioners that they need to be saved from being subjected to harassment without any course of law at the end of the respondent Nos. 3 to 5. 04. The present writ petition is, accordingly, dismissed as withdrawn with liberty to file fresh one.
