The petitioner's grievance with regard to non-release of the vehicle in which mining material was being transported, bearing registration No. PB-06BF-8065, can more appropriately be examined by the 3rd respondent at the first instance. The representation has already been made to the concerned respondent. Learned State counsel, on instructions, states that the claim of the petitioner shall be examined in accordance with law. In that view of the matter, we dispose of this petition with a direction to the 3rd respondent to pass an appropriate order on the petitioner's pending application, in accordance with law, within a period of four weeks. Needless to state that this order shall not be treated as an expression of opinion on the merits of the case of either party, for, as indicated above, the competent authority shall examine the concerns/grievances of the petitioner, strictly in accordance with law.
