ORDER 28-03-2025 Heard Mr. N. J. Dutta, learned counsel for the petitioner and Mr. M. P. Goswami, learned Additional Public Prosecutor, Assam. 2. The petitioner, namely, Shahil Ahmed, son of Sattar Ali Ahmed, resident of Village- Khaplar Vita, P.O.- Koyakuchi, Police Station-Barpeta, District-Barpeta, Assam, has filed this application under Section 483 BNSS, 2023 on 24.03.2025 seeking bail in Palashbari Police
Page No.# 2/3 Station Case No. 511/2024 registered under Sections 318(4)/303(2) BNS, 2023, corresponding to G.R. No.1532(K)/2024, in which he was shown arrested on 29.01.2025 and is in custody since then. 3. Petitioner’s earlier Bail Appln. No. 369/2025 in said Palashbari P.S. Case No. 511/2024 was rejected by this Court vide order dated 18.03.2025. 4. After being shown arrested on 29.01.2025, the petitioner was produced before the Court of learned Chief Judicial Magistrate, Kamrup, Amingaon on 29.01.2025 in said Palashbari P.S. Case No. 511/2024 and he is custody for about 59 days till date in said Palashbari P.S. Case. 5. On being enquired, M. P. Goswami, learned Addl. PP, Assam submitted that charge sheet in said Palashbari P.S. Case No. 511/2024 has not been filed till date. 6. Since 29.01.2025, the petitioner has been in custody till date for about 59 days. In view of the above, the petitioner is entitled for bail in said Palashbari P.S. Case No. 511/2024. 7. Accordingly, the petitioner, namely, Shahil Ahmed, son of Sattar Ali Ahmed, if not wanted in any other criminal/police station cases, is granted bail in said Palashbari P.S. Case No. 511/2024 registered under Sections 318(4)/303(2) of BNS, 2023 corresponding to G.R. No. 1532(K)/2024, on furnishing a bail bond of Rs.
75,000/- with two local sureties each of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup, Amingaon on condition that the petitioner – (i) shall appear before the Investigating Officer of said Palashbari P.S. Case No. 511/2024 every fifteen days in working days during the office hours for the next three English Calendar months, commencing from 08.04.2025 and also as and when he is required for necessary investigation of said Palashbari P.S. Case; (ii) shall not leave the territorial jurisdiction of Palashbari Police Station, without obtaining prior written permission from the concerned Investigating Officer of the case; (iii) shall not hamper with the investigation, or tamper with the evidence of the
Page No.# 3/3 case; (iv) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer and (v) shall not involve himself in any criminal activities in future. (vi) in the event of filing any charge-sheet against the petitioner in said Palashbari P.S. Case No. 511/2024 corresponding to G.R. No. 1532(K)/2024, he shall appear before the concerned Trial Court and shall obtain regular bail in the case and shall also appear in the case, on the dates fixed and shall participate in the trial of the said case, without fail till its conclusion. 8. Violation of any of the aforesaid terms and conditions by the petitioner, Shahil Ahmed, son of Sattar Ali Ahmed, then the bail granted to him in the aforementioned Palashbari P.S. Case No. 511/2024 shall stand automatically vacated. 9. Accordingly, this bail application stands disposed of to the extent above. JUDGE Comparing Assistant
