At the outset, learned counsel for the respondents raised a preliminary objection qua the maintainability of the writ petition on the premise that the dispute is inter se between the Development Authority and the petitioner- Welfare Society. 5. It is also informed that in response to the earlier Court order dated 04.04.2018 passed in Writ C No. 12296 of 2018 (Ishwar Pal and others vs. State of U.P. and 3 others) wherein a direction was issued to appoint an Arbitrator and later on the District Magistrate, Meerut who was appointed as an arbitrator in the said proceeding had passed an award dated 06.02.2024 and accordingly the notice was also issued. Consequently a civil suit was preferred being Original Suit No. 57 of 2024 wherein the status quo order has also been maintained. 6.
