This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Sections 126(2), 115(2), 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 pending in the court of J.M. 1st Class, Hazaribagh in connection with Barkagaon PS Case No. 303 of 2024.

Learned counsel for the petitioners submits that there is a case and counter case as there was fight amongst both the parties which resulted in this case.

Learned counsel for the informant opposes the prayer for anticipatory bail and submits that the assault is grievous on the head, that too, by axe.
5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail and submits that there is direct allegation against these petitioners that they have assaulted with the axe

on the head causing serious injuries.
6. Considering the submission of learned counsel for the State and the informant since there is an allegation of assault with axe, that too, on the head, this Court finds it not a fit case for grant of anticipatory bail to the petitioners.
7. Accordingly, this Anticipatory Bail Application stands dismissed.
