Also heard Ms. M Kumari, the learned Standing Counsel appearing for the CBI. Page No.# 2/2 2. This application has been filed under Section 482 of the BNSS, 2023, in respect of CBI/ACB Guwahati P.S. Case No. RC0172025A80002. 3. The petitioner is the Principal Scientist of CSIR/NEIST, Jorhat. The allegation brought against him is that he had purchased some goods from M/S Assam Chemicals and Instrument Corporation, owned by Sri Pobon Chandra Borah, at exorbitant prices causing loss to the Corporation. 4. It is further alleged that the petitioner did so in lieu of receiving one Laptop and one I-phone. According to the informant, those objects were demanded by the petitioner alongwith a cash amount of ₹1.6 lakh. 5. This Court granted interim bail to the petitioner on 26.03.2025. Pursuant to the interim order of this Court, the petitioner has already appeared four times before the Investigating Officer. However, his son and his brother-in-law also appeared before the Investigating Officer once. 6. Today, Ms. Kumari has submitted that the petitioner has handed over his mobile phone and the Laptop. According to Ms. Kumari, the petitioner is not co-operating with the Investigating Officer. Today Mr. Konwar has submitted that the petitioner has already handed over his mobile phone alongwith SIM card. He is now ready to hand over his personal Laptop also to the Investigating Officer. 7. Ms. Kumari has submitted that since this is a criminal offence, the petitioner should not be granted anticipatory bail. 8. I have considered the submissions made by the learned counsel of both sides. 9. Pursuant to the interim order, the petitioner has appeared before the Investigating Officer and has cooperated with the investigation. 10. This Court is of the opinion that under the given circumstances the petitioner does not deserve to be detained in custody. 11. Therefore, the pre-arrest bail application of the petitioner is allowed. 12. The interim bail granted to the petitioner by this Court on 26.03.2025 is hereby made absolute.
