Chaturvedi, learned counsel for the petitioner and Sri Manish Kumar, learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner, who is working as Block Mission Manager, is aggrieved by the order of recovery dated 30.01.2024 and 03.09.2025 as those orders have been passed without affording any opportunity of hearing to the petitioner. Learned Standing Counsel though sought to defend the orders for the alleged irregularities mentioned therein for wrongful act at the end of petitioner but could not demonstrate from the orders that the petitioner was ever given any notice much less a show cause notice prior to passing of the impugned orders. In view of the above, I consider it more appropriate that the authorities may revisit the matter and hence I direct the petitioner to offer his explanation treating the dated 30.01.2024 and 03.09.2025 as a show cause. The reply shall be submitted by the petitioner within a period four weeks from today and after he submits explanation by way of reply, the same shall be considered and disposed of by District Development Officer/ Commissioner, Self Employment Scheme, Azamgarh within a further period of two months. Until such decision is taken, as directed herein above, the orders dated 30.01.2024 and consequential order dated 03.09.2025 shall remain in abeyance and shall abide by the final outcome Versus Counsel for Petitioner(s) : U.C.
