Neutral Citation No. - 2025:AHC:106683 Court No. - 47 Case :- CRIMINAL REVISION No. - 5090 of 2024 Revisionist :- Abhishek Mishra Opposite Party :- State Of U.P. And Another Counsel for Revisionist :- Abhay Kumar Kushwaha Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. As per office report dated 19.11.2024, notice has been served on opposite party no.2, but no one has turned up to opposed this revision. Heard learned counsel for the revisionist, learned A.G.A. for the State. The present criminal revision has been preferred against the judgment and order dated 23.07.2024 passed by the Juvenile Appeal/Special Judge (POCSO Act), Chandauli, in the Juvenile Appeal No. 24/2024 (Juvenile Vs. State of U.P. and others) whereby the juvenile opposite party no. 2 has been directed to be enlarged on bail by the Children's Court. Learned counsel for the revisionist submits that bail application of the juvenile, respondent no.2 was rightly rejected by the Board and he does not deserves to be enlarged on bail. Counter-affidavit has been filed by State supporting the orders passed by the Board and stating that allegations against the revisionist are serious and he is involved in commission of offence of heinous motive, and therefore, he does not deserves to be enlarged on bail. This Court finds that Children's Court has granted bail to the revisionist considering the provisions of Section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2015. It has found that the opposite party no.2 has no previous criminal history. The revisionist could not point out any illegality in the orders passed by the Children's Court. The revision lacks merits and is hereby dismissed. Order Date :- 7.7.2025///Abhishek Digitally signed by :- ABHISHEK YADAV High Court of Judicature at Allahabad
