1. Heard on I.A. No.2 for exemption from filing typed copy of documents. Since the matter is being finally disposed of, I.A. No.2 is allowed and the petitioners are exempted from filing typed copy of the documents.
2. By this petition, the petitioners seek the following reliefs:
“(i) To kindly direct the respondent to follow the circular/notification issued time to time by respondent department dated 17.06.2013, 20.02.2014 and 14.11.2019 by G.A.D for the recruitment process (For post Hostel Superintendent Grad-'D'), 2024 in its true spirit.
3 (ii) To kindly direct the respondent no. 3 to prepare fresh final Document verification list on the basis of category in which the candidate has appeared in the examination and applied for the said post and belonging to PVTG category and consider the petitioners and further to give appointment on said post of Hostel Superintendent-'D'. (iii) To kindly direct the respondent Commissioner, Schedule Caste and Schedule Tribe Development Department Raipur, Chhattisgarh to appoint the petitioners to the post of Hostel superintendent Grad-'D'. (iv) To kindly grant any other relief which seems just and fair in the eyes of law.”

Learned counsel appearing for the petitioners submits that an advertisement was issued by respondent No.3 vide advertisement number Vyapam/2024/0478 dated 1.3.2024 for the post of Hostel Superintendent Grade-D for Hostels run under respondent No.3 Department. On perusal of the advertisement, it would be evident that total 300 posts were advertised, out of which 87 were reserved for Scheduled Tribe and 34 for only Woman candidate belonging to Scheduled Tribe and also have a Chhattisgarh Domicile Certificate and 29 for Scheduled Tribe (backlog) apart from posts reserved for female domicile residents of State of Chhattisgarh and Ex- serviceman. Therefore, a total of 150 posts were reserved for Scheduled Tribe. The petitioners filled their application form for the post of Hostel Superintendent Grade- D. The petitioners are in possession of the requisite educational qualifications as prescribed by the respondents in the advertisement, namely, Higher Secondary Certificate and preferential qualification i.e. computer training. The petitioners were also belonging to Korwa (Pahari Korwa) Tribe which has been recognized by the State of Chhattisgarh as Particularly Vulnerable Tribal Group Category. Learned counsel further submits that similar identical petitions have also been decided in light of the said circular and appointment orders have also been issued to the similarly
4 situated candidates. He also submits that the petitioners may be given liberty to file a representation raising all their grievances before the concerned respondent authority to consider and decide their claim within a stipulated period.

Learned counsel appearing for the State does not oppose the submission made on behalf of the petitioners.

Considering the submissions made by the parties and further considering the aforesaid aspect of the matter, the petitioners are granted liberty to file a representation raising all their grievances before the authorities concerned within a period of ten days from the date of receipt of a copy of this order and, in turn, the authorities concerned are directed to consider and decide the said representation of the petitioners while passing appropriate orders in a pragmatic manner in accordance with law within a period of 15 days from the date of receipt of such representation.
6. With the aforesaid observations and directions, the writ petition is disposed of. Sd/-
