Heard the parties.
The petitioner has been made accused in connection with Kamdara P.S. Case No. 40 of 2014, corresponding to Spt. II G.R. Case No.1180 of 2014, S.T. Case No.242 of 2018, for the offence under Sections 147, 148, 149, 302, 379, 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the CLA Act, pending in the court of learned Additional Sessions Judge-II, Gumla.
On 03.11.2014, petitioner alongwith co-accused persons, who are members of PLFI, an extremist organization, are alleged to have murdered seven persons.
It was submitted that the informant, who is an only eyewitness to the occurrence, has not supported the prosecution case and as such, he has been declared hostile. It was further submitted that similarly situated co-accused persons have been granted bail by the different Coordinate Benches of this Court earlier. It was also submitted that petitioner is in custody for about nine years.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Gumla, in connection with Kamdara P.S. Case No. 40 of 2014, corresponding to Spt. II G.R. Case No.1180 of 2014, S.T. Case No.242 of 2018.
