CRM-M-49157-2025 (O&M) -2- The relevant facts of the present case for adjudication are that earlier the petitioner had been granted regular bail by this Court vide order dated 15.03.2021. The petitioner could not appear before the trial Court on 17.01.2025 and his bail order as well as surety bonds were cancelled and forfeited to State and he was ordered to be summoned through warrants of arrest. Thereafter, the petitioner approached this Court for seeking quashing of order dated 17.01.2025. This Court while disposing of the petition bearing No.CRM-M-16447-2025 directed the petitioner to appear before the trial Court within next 10 days and on doing so, the petitioner be released on regular bail. Despite the abovementioned order passed by this Court, the petitioner again did not appear before the trial Court on 09.04.2025, as allegedly the petitioner fell seriously ill. In the meantime, when the case was again listed before the trial Court on 14.05.2025, warrants of arrest were issued against him for 14.05.2025. It has been contended by learned counsel for the petitioner that the absence of the petitioner on 14.05.2025 was not intentional rather the petitioner was suffering from Dengue fever, due to which he could not appear before the trial Court on the aforesaid date. He further submitted that now the matter is fixed for 08.10.2025 before learned trial Court and he is ready to surrender before the trial Court and requested that the impugned
order dated 14.05.2025 be set aside. Heard. Considering the facts and circumstances of the present case and to enable the petitioner to join the proceedings pending before the trial Court and to expedite the proceedings in trial, the impugned order dated 14.05.2025 is set aside. The petitioner is directed to surrender and appear KOMAL 2025.09.15 10:08 I attest to the accuracy of this document
