...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, or order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 4 and 5 in not reinstating the petitioner into service as Field Assistant in M.G.N.R.E.G.S., Dosudiki Village, Guntakal Mandal, Ananthapuramu District inspite of the fact that the said allegation was made against the petitioner by mistake, as highly illegal, arbitrary and unconstitutional being violative of Articles 14 and 21 of the Constitution of India and also violative of principles of natural justice and consequently direct the respondents to reinstate the petitioner into service as Field Assistant in M.G.N.R.E.G.S., Dosudiki Village, Guntakal Mandal, Ananthapuramu District and pay the arrears of salary to the petitioner, in the interest of justice and pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 4 and 5 herein to reinstate the petitioner into service as Field Assistant in M.G.N.R.E.G.S., Dosudiki Village, Guntakal Mandal, Ananthapuramu District and pay the arrears of salary to the petitioner, pending disposal of the writ petition, in the interest of justice and pass Counsel for the Petitioner:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, or order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 4 and 5 in not reinstating the petitioner into service as Field Assistant in M.G.N.R.E.G.S., Dosudiki Village, Guntakal Mandal, Ananthapuramu District inspite of the fact that the said allegation was made against the petitioner by mistake, as highly illegal, arbitrary and unconstitutional being violative of Articles 14 and 21 of the Constitution of India and also violative of principles of natural justice and consequently direct the respondents to reinstate the petitioner into service as Field Assistant in M.G.N.R.E.G.S., Dosudiki Village, Guntakal Mandal, Ananthapuramu District and pay the arrears of salary to the petitioner, in the interest of justice and pass…”

When the matter is taken up for hearing, Sri M.S.R.Chandra Murthy, learned Standing Counsel for the Respondents, basing upon the written instructions received from the Project Director would submit that the Petitioner has given a representation that “he is withdrawing the W.P.No. 4807 of 2018 on personal reasons and requested to post the matter before the Hon’ble High Court under withdrawn caption”. Learned Standing Counsel would further submit that the Mandal Parishad Development Officer/Programme Officer, MGNREGS, Guntakal Mandal has intimated the fact and submitted the Writ Petition Withdrawn representation of above Ex-Field Assistant. Learned Standing Counsel would submit that in view of the same, no further orders are required in this matter. The Written instructions along with the letters is placed on record. 4
4. Sri K. Srinivas, learned Counsel for the Petitioner would submit that recording the same, the petition may be disposed of. 5. Recording the same, the Writ Petition is disposed of. No order as to Costs.
