Neutral Citation No. - 2025:AHC:68998-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 1132 of 2025 Petitioner :- Krishna Kumar Srivastava Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Neeja Srivastava,Sr. Advocate Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J.
1. Heard learned counsel for the petitioner and learned A.G.A. for the State respondents.
2. Present petition has been filed seeking direction to respondents to ensure fair, impartial and proper investigation of the Case Crime No. 106 of 2024 under Section 103 B.N.S. 2023, Police Station Kotwali, District Prayagraj.
3. While entertaining the present writ petition, Co-ordinate Bench of this had taken note that the instant first information report has been lodged way back on 29.09.2024, however the police is not investigating the matter in fair and impartial manner and the investigation is being done in a lackadaisical manner and, accordingly, two weeks' time was granted to learned A.G.A. to file counter affidavit bringing on record as to what steps were taken for ensuring fair investigation.
4. Considering the factual situation as detailed counter affidavit is still awaited, we are of the view that no further relaxation should be granted to the Investigating Officer to move on that snail pace as the first information report was lodged way back on
29.09.2024.
5. In view of the above, the present petition is disposed of directing that the investigation be concluded by the Investigating Officer under the supervision of Deputy Senior Superintendent of Police, Prayagraj fairly, impartially and expeditiously preferably within a period of three months from the date of production of certified copy of this order.
6. It is made clear that this Court has not expressed any opinion on the merits of the case and the Competent Authority/Investigating Officer to act in accordance with law.
