2. The allegations in this case are that on 08.01.2020, the accused protested against central government for their democratic right without due permission. A case was registered in Cr. No. 08/2020 on 08.01.2020 for the alleged offences under Sections 143 and 341 of Indian Penal Code, 1860. The final report was filed on 28.06.2020, and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.
3. Accordingly, the proceedings in S.T.C.No.684 of 2020, on the file of the Judicial Magistrate No.III, Erode Taluk, Erode stands quashed and consequently, this Suo Motu Transfer Case is also disposed of. 18.09.2025 gsa Note to the Trial Court: This order is digitally signed and communicated electronically alone.
