CR-5885-2022 [2] proceedings would primarily prejudice the petitioners. It is submitted that in the present case, as is apparent from the impugned order, examination-in- chief of PW1 and PW2 had been conducted and on 23.09.2022, it is the counsel for the respondents/defendants who had sought adjournment to cross-examine the said witnesses and it is on the said date that evidence of the petitioners was closed except for the purpose of cross-examination of PW1 and PW2. It is submitted that the suit, in the present case, was filed through Mahant Pritam Dass and plaintiff No.2 in the suit was Subhash and both the said Mahant Pritam Dass and Subhash had died during the pendency of the suit on account of which the plaintiffs could not lead evidence on certain dates. It is submitted that in case, the plaintiffs/petitioners are not given one effective opportunity to lead their entire evidence, at their own responsibility, then irreparable loss would be caused to them.
3.
Learned counsel for the petitioners has fairly submitted that in the present case, the evidence of the defendants has already been recorded and has submitted that in case the present petition of the petitioners is allowed then they would have no objection in case the defendants are given opportunity to rebut the evidence to be led by the petitioners.
