Plaintiffs filed appeal against the order rejecting their plaint. In that appeal, Respondent No. 1 moved application under Order 1 Rule 10 CPC for his impleadment. Petitioner has approached this Court for quashing that application filed by Respondent No. 1. 4. The writ petition is without any cause of action as no order is passed by the Appellate Court on the application filed under Order 1 Rule 10 CPC. 5. Thus, there is no scope for interference in the matter. 6. The writ petition is disposed of with liberty to petitioner to file objection before the Court concerned.
