The petitioner has been made accused in connection with Jainagar P.S. Case No.211 of 2024 registered for the offences punishable under Sections 303(2), 334(2) of B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed theft in the jewellery shop of the informant. It is further submitted that petitioner himself is an owner of the jewellery shop and due to business rivalry, he has been accused in this case, as well as two other cases. It is submitted that the allegation against the petitioner is false. It is then submitted that petitioner has been implicated in this case only on the basis of confessional statement of co-accused persons. It is next submitted that nothing has been recovered from the possession of the petitioner. It is further submitted that petitioner has been in jail custody since 09.01.2025. It is next submitted that the petitioner undertakes that he will co- operate with the trial of the case. It is next submitted that the co-accused person has already been admitted to bail by Co-ordinate Bench of this Court vide order dated 27.05.2025 in B.A. No.4340 of 2025. Hence it is submitted that the petitioner be released on bail. Learned Addl.P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Koderma in connection with Jainagar P.S. Case No.211 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
