an appropriate writ in the nature of mandamus for a direction/directing the respondent authorities to consider the case of the petitioner and select him for the allotment of PDS dealership shop in Panchayat-Mangalpur Ausani which is general category in Roster
Patna High Court CWJC No.9169 of 2019 dt.22-09-2025 2/3 wise reservation and further for providing the relief/reliefs as deemed fit and proper for the petitioner who is handicapped also by 45%.
2. It is the specific contention of the
Learned counsel for the petitioner that the petitioner has already preferred a complaint before the Divisional Commissioner, Tirhut, Muzaffarpur on 26.02.2019 vide Annexure-6, which is still pending.
3. As the Divisional Commissioner has not been impleaded as a party in the present Writ petition, the petitioner intends to file a fresh complaint/application before the Divisional Commissioner incorporating the subsequent developments.
4. Therefore, this court directs the petitioner to file a fresh complaint/application once again before the Divisional Commissioner within a period of one month from the date of receipt of this
order. In turn, the Divisional Commissioner shall dispose of the complaint/application of the
Patna High Court CWJC No.9169 of 2019 dt.22-09-2025 3/3 petitioner within a period of three months from the date of filing of the complaint/application. The petitioner is also directed to appear before the Divisional Commissioner and to make his submission before him prior to the disposal of the case.
5. With the aforesaid observations, the Writ petition stands
