JUSTICE SANJAY PRASAD ----- For the Petitioner : None For the State : Mr. Rajnesh Vardhan, A.P.P ------ Order No: 13/ Dated: 17.01.2025 It appears from the counter affidavit dated 03.12.2024 filed on behalf of the State in the light of order dated 21.11.2024 passed by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Kumar) in which it has been stated that the petitioner namely Suleman Tirkey has died during pendency of this instant case and photocopy of Death Certificate of the petitioner Suleman Tirkey issued by Registrar (Birth & Death), Gram Panchayat, Paika is enclosed at Page-7 of the counter affidavit dated 03.12.2024. 2. The above counter affidavit has been filed by one Amit Kumar Das who is working on the post of Sub-Inspector, Namkum, P.S., Ranchi and it has been stated in Para-5 and Para-7 that when notice was tried to be served upon the petitioner then it was informed by the son of the petitioner namely Sushil Tirkey that the Revisionist petitioner has died. 3. Thus, this Criminal Revision stands abated on account of death of the petitioner Suleman Tirkey under Section 394 of Cr.P.C. 4.
