This writ petition has been filed seeking following relief :- "Issue a writ, order or direction in the nature of Certiorari to quash the impugned order dated 03.09.2024 passed by Additional Commissioner (Administration) Prayagraj arising out of proceedings u/s 24 of U.P. Revenue Code, 2006. ii) Issue a writ, order or direction in the nature of Mandamus directing the parties to maintain status quo over the land in question i.e. Gata No. 2247 area 0.570 Hectare, situated village Gauri Pargana and Teshil Soraon, District Prayagraj." 2. Perused the order dated 3.9.2024 impugned in the writ petition passed by respondent No.2. The said order has been passed in appellate jurisdiction while entertaining the appeal filed by the other side and Appellate Court has also stayed the operation of order passed by the S.D.M. dated 5.8.2024 during pendency of the appeal. 3. Since the injunction has been granted by the Appellate Court, petitioners have remedy of filing an application for vacation of interim injunction which has been granted by the Appellate Court. 4. In view of the same, I am not inclined to interfere in the matter. 5. Accordingly, this writ petition stands disposed of with liberty to the petitioner to file an appropriate application for vacation of interim order granted by the Appellate Court. In case such an application is filed, the same shall be considered and decided by the Appellate Court, in accordance with law, expeditiously preferably within four weeks from the date of filing of an application after ensuring services of notices upon all the respondents and also providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
