The present writ petition under Article 226 of the Constitution of India is filed by the petitioner to ensure a fair and impartial investigation of F.I.R. No.0003 of 2025 registered on 27.07.2025 at Police Station Kanalichhina, District Pithoragarh relating to offences punishable under Sections 109, 140(3), 191(3) and 324(2) of B.N.S., 2023 or to transfer the same to some other independent agency and further commanding the official respondents to arrest the accused persons with regard to the abovementioned F.I.R. so that they may not tamper with the evidence and influence the witnesses and submit the progress of investigation before this Hon’ble Court. 4. As per order dated 11.08.2025 passed by the Coordinate Bench of this Court, personal appearance of Investigating Officer was directed in light of the prayer made by the petitioner in 2025:UHC:7460 his petition. 5. Sub-Inspector, Ms. Arti, Station In-charge, Police Station Kanalichhina, District Pithoragarh is heading the investigation of the Case Crime No.0003 of 2025 against which for a speedy disposal and fair procedure to be adopted. 6. Sub-Inspector, Ms. Arti, Station In-charge, Police Station Kanalichhina, District Pithoragarh is present before this Court, who made written submissions regarding the proceedings of the said case and after having an interaction, this Court is convinced that the matter, as per her statement will be concluded soon and charge- sheet will be filed within time before the concerned court. 7. Among the star witnesses, including the injured, statements have been recorded and statement have also been recorded of the concerned Medical Officer, who conducted the medical examination of the injured person; she further makes a submission that since the injuries are observed to be in grave nature infected on the vital part of the body of the injured, investigation is, accordingly, being conducted in such consideration. She further submits that there are three vital witnesses that are yet to be examined, they are supposed to be eye-witnesses of the incident in the present matter and soon after, as per the time prescribed under the law, the 2025:UHC:7460 conclusion of the investigation will be done and the charge-sheet in appropriate offences will be submitted before the concerned court. 8. In view of the observations made above, this Court is satisfied that the matter may be concluded as far as the charge-sheet is concerned, as per the time prescribed under the law. 9.
