1. Heard Sri Sanjay Singh, learned counsel for petitioner and Sri P.K. Shahi, learned Additional Chief Standing Counsel for State-Respondents.

Sarkari Sewak (Chikitsa Parichaya) Niyamawali, 2022 has a provision that in case the bills are submitted beyond three months, it can be considered with approval of Departmental Secretary. However, admittedly in the present case, the matter was not referred to Departmental Secretary. Petitioner has not submitted any application in terms of Regulation 23 either at the stage of filing of bills in due format or before impugned order was passed.

Learned Additional Chief Standing Counsel submits that claim was rejected in view of Regulation 16 of Regulations, 2011 and that so far as applicability of Regulation 23 is concerned, he submits that there was no application even to condone the delay.
