APHC010108772024 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3525] TUESDAY, THE ELEVENTH DAY OF MARCH TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE R RAGHUNANDAN RAO THE HONOURABLE DR JUSTICE K MANMADHA RAO WRIT APPEAL NO: 239/2024 Between: Simhadri Chandra Sekhar and Others ...APPELLANT(S) AND Simhadri Veera Venkata Narasimha Murthy Died and Others ...RESPONDENT(S) Counsel for the Appellant(S): 1. G VENKATA SUBBA RAJU Counsel for the Respondent(S): 1. GP FOR REVENUE 2. The Court made the following Order: (per Hon’ble Sri Justice R. Raghunandan Rao) There was a dispute between the father of the appellants herein and his brother due to which an appeal was filed by the brother of the father of the appellants before the Revenue Divisional Officer for change in the revenue record. The Revenue Divisional Officer by order dated 27.07.2016 refused to intervene and left it open to the parties to settle their land disputes before the 2 Civil Court as civil disputes were involved. Aggrieved by this order, the brother of the father of the appellants moved to the Joint Collector, by way of a revision, under Section 9 of the ROR Act which came to be dismissed on 27.03.2021 for the same reasons given by the Revenue Divisional Officer. 2. Aggrieved by the same, Writ Petition No.17563 of 2021 was filed by the appellants herein. A learned Single Judge of this Court by order dated 19.08.2021 had dismissed the writ petition on the ground that no case is made out in as much as the observations of the Revenue Divisional Officer and the Joint Collector that it would be appropriate that the disputes are resolved in the civil Court does not require interference. 3. Aggrieved by the said order, the present writ appeal has been filed. We do not find any reason to interfere with the order of the learned Single Judge in as much as Section 8(2) of the ROR Act also provides an ample opportunity to the appellants and the private respondents to resolve their disputes through the Civil Court. 4. Accordingly, the Writ Appeal is dismissed. No costs. 5. As a sequel, miscellaneous applications, if any, shall stand closed. ________________________ R.
