HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 32909 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J. 1. This writ petition assailed the order of eviction passed under Section 67 of the U.P. Revenue Code, 2006, as well as the order passed in appeal under Section 67(5) of the U.P. Revenue Code, 2006. The eviction proceedings were initiated on the ground that the petitioner had encroached upon the land of the Gaon Sabha over Khasra No. 571 which is recorded as a 'Panchayat Ghar'. Learned counsel for the petitioner fairly concedes that apart from the house constructed over the property, the petitioner do not have any other place to live. He has also submitted that the Revenue Inspector in his report stated that without making an alternative arrangement for the petitioner, he should not be evicted. 2. This Court finds that the petitioner has no case and has openly admitted the fact that he has constructed the house over the land of the Gaon Sabha. 3. No case for interference is made out under Article 226 of the Constitution of India. 4. The writ petition fails and stands dismissed. However, in case, any application under Section 67A is moved by the petitioner, the same shall be considered by the revenue authorities strictly in accordance with law. September 18, 2025 A. V.
