KOPPISETTI PARVATI DEVI Counsel for the Respondent/complainant: 1.PuBLIC PROSECUTOR The Court Made the foI[owinq Order: This Criminal Petition, under Sections 480 and 483 of BNSS, has been filed by the petitioners herein/accused Nos.1 and 2, seeking regular bail, in Crime No.249 of 2024 of Parvathipuram Rural Police Station, Parvathipuram Manyam District, registered for the offence punishable under Sections 20(b)(ii)(B) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short `the NDPS Act? . 2. Case of the prosecution, in brief, is that, on 05.12.2024, on receipt of credible information about illegal transportation of GanJ'a, the Sub-Inspector of Police along with his staff and mediators rushed to the outskirts of Adaru village, and caught the accused in possession of 12.606 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. E= iE -I '- JJ 3. Heard. Perused the record. 4. Learned counsel for the petitioners submits that the petitioners are in judicial custody since 05.12.2O24. Learned counsel for the Petitioners further Submits that the Petitioners have Permanent abode and there is no possibility of their fleeing away from the jurisdiction of the Court. 5. The petitioners are in judicial custody since o5.12.2024. The quantity of Ganja allegedly seized from the possession of the Petitioners iS 12.606 Kgs. It is submitted by the learned Assistant Public Prosecutor that the petitioners herein have no previous crime record. As most of the investigation might have been completed by this time and most of the witnesses are shown to be official witnesses, the release of the accused would not cause hampering of investigation. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners herein/accused Nos.1 and 2. 7. Accordingly, the Criminal Petition is allowed. The petitioners herein/accused Nos.1 and 2 shall be released on bail on each of them executing a personal bond for a sum of Rs.25,OOO/- (Rupees Twenty Five Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Parvathipuram.
