The petitioner has the remedy to file an appeal before the Commissioner, Ghaziabad under Section 6 of the Act, 1970. In view of the availability of alternative remedy to the petitioner, it is not a case for taking cognizance under Article 226 of the Constitution of India, at this stage. The petition is dismissed. In case the appeal is filed within ten days from today, the said appeal shall be heard and decided on merits.
