Case No. 118 of 2025 dated 02.04.2025, registered for the offences punishable under Sections
Patna High Court CR. MISC. No.85305 of 2025(2) dt.24-12-2025 2/3 191(1), 190, 303(2), 115(2), 126(2), 109, 191(3) and 299 of the B.N.S., 2023. 3.
The allegation against the petitioners is of causing assault to the informant by means of lathi, danda and deadly weapons leading to injury to the informant as well as other persons who came to his rescue. 4. Learned Advocate appearing on behalf of the petitioners submits that the occurrence has taken place on account of a trifle resulting into disruption in the communal harmony leading to institution of three cases, one by the Block Development Officer, another by the informant and the third has been instituted by the persons of the petitioners’ side. From the narratives of the FIR, it is evident that there is omnibus allegation against altogether 35 named accused persons and 20 to 25 unknown persons without specific accusation against the petitioners. Prior to the institution of the present FIR as well as the FIR lodged by the Block Development Officer, the petitioners had absolutely clean antecedent. Now, the communal harmony have also been restored as per the contention of the learned Advocate for the petitioners. 5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that the petitioners are found involved in disrupting the communal harmony besides the allegation that they have actively participated

Regard being had to the submissions advanced by the learned Advocates for the respective parties and taking note of the omnibus nature of the accusation, coupled with the fact that prior to the incidence the petitioners have fair antecedent as also the undertaking given by the petitioners that they shall maintain communal harmony, let the petitioners, above-named, be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Nasariganj P.S. Case No. 118 of 2025, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioners.
