Learned counsel also submits that father of the accused-applicant paid Rs.1,00,000/- to one-Mahadev, who is said to be the co-owner of the disputed land. Learned counsel argues that the father of the accused-applicant has died and after his death, the accused-applicant contacted the owners of the land and purchased the land-in-question through registered sale deed. Accused- applicant has also applied for correction in the revenue record and the matter is pending before the SDO, Amer. Learned counsel also argues that the accused-applicant is a bonafide purchaser.
Learned counsel contends that the charge-sheet has been filed for the offences punishable under Sections 420, 467, 468, 471 & 120-B of IPC against the accused-applicant and all the charges are triable by Judicial Magistrate. Learned counsel further contends that the accused-applicant is an employee of the Indian Railway and posted at Jodhpur, therefore, there is no chance of absconding the accused-applicant. Learned counsel prays that the accused- applicant was arrested on 11.02.2025 and since then, he is behind the bars. Learned counsel also prays that the trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other hand, learned Public Prosecutor opposes the bail application.
4. Heard learned counsel for the parties and also perused the material available on record.
5. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is a Government Servant; that the accused-applicant is behind the bars since 11.02.2025; that the charge-sheet has been filed and all the
[2025:RJ-JP:29513] (3 of 3) [CRLMB-3214/2025] charges levelled against the accused-applicant are triable by Judicial Magistrate; that the trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.
